Government watchdog organization Judicial Watch has filed a Freedom of Information Act (FOIA) lawsuit against the Justice Department seeking “all written and audio/visual records of any FBI/DOJ discussions regarding the 25th Amendment and plans to secretly record President Trump in the Oval Office,” according to a press release.
The FOIA suit comes following new revelations from fired FBI Deputy Director Andrew McCabe who has claimed in interviews that he was involved in discussions with Deputy Attorney General Rod Rosenstein in 2017 to convince enough of the president’s Cabinet members to support invoking the amendment so they could remove him on grounds he wasn’t fit to serve.

In addition, McCabe has said that Rosenstein on more than one occasion offered to wear a wire to record POTUS Trump saying something that could be used to convince Cabinet members to support the coup effort.
As we previously reported citing additional sources, at least two Cabinet members were considering supporting invoking the 25th Amendment.
“It is no surprise that we are facing an immense cover-up of senior FBI and DOJ leadership discussions to pursue a seditious coup against President Trump,” said Judicial Watch President Tom Fitton.
“This effort to overthrow President Trump is a fundamental threat to our constitutional republic so Judicial Watch will do everything it can in the courts to expose everything possible about this lawlessness,” he added.
Judicial Watch noted in its statement, “On February 14, 2019, former acting FBI Director Andrew McCabe stated in an interview with CBS that ‘there were conversations about the possibility of removing Trump under the 25th Amendment and confirming that Deputy Attorney General Rod Rosenstein had offered to wear a wire around the president.’
“After President Trump fired then-FBI Director James Comey [in May 2017], reportedly top DOJ officials discussed whether to recruit cabinet members to invoke the 25th Amendment to remove President Trump from office,” the statement noted further.
In September 2018, it was reported that Deputy Attorney General “suggested that he secretly record President Trump in the White House in an effort to invoke the 25th Amendment and have President Trump removed.”
Rosenstein, who is on his way out of the Justice Department, has denied he was serious about wearing a wire to record the president. But McCabe told CBS News‘ “60 Minutes” on Sunday that Rosenstein was serious.
“The deputy Attorney General offered to wear a wire into the White House,” said McCabe. “He was not joking. He was absolutely serious. And in fact, he brought it up in the next meeting we had.”
“Rosenstein said, ‘I never get searched when I go into the White House,’” McCabe stated. “I could easily wear a recording device. They wouldn’t know it was there.’”
Constitutional scholar, famed defense attorney, and best selling author Alan Dershowitz said on Feb. 14, “If [McCabe’s comments are] true, it is clearly an attempt at a coup d’état.”
Supporters of the president note that had Hillary Clinton won the 2016 election, Americans would have never learned anything about the plot against her GOP opponent.
